Navy Corpsman Killed While Riding Bike at Camp Lejeune

Comments (0)

What Happened:

A Navy corpsman was killed after being hit by a car while riding a bike at Camp Lejeune in North Carolina (NC). The victim was traveling along Highway 172 aboard Camp Lejeune just after 6 a.m. when a car hit him at the Hammocks Bay Road intersection, according to wwaytv13.com.

This tragic accident remains under investigation.

Our deepest condolences go out to the victim’s family. Losing a loved one is one of the most difficult experiences anyone has to suffer through, but the pain is made even worse when the loss is so sudden.

The North Carolina Injury Lawyer’s Perspective:

The victim’s family may have grounds to pursue a wrongful death claim against the driver. However, many factors need to be assessed before legal action can be taken. First and foremost, we have to determine what exactly caused the accident. Why? Because in North Carolina, along with only a handful of other states, the doctrine of contributory negligence is utilized. This archaic doctrine sets forth that if an accident victim is even 1% at-fault, they are barred from recovery in court. Therefore, if, hypothetically, the victim in this accident was not wearing a helmet or was riding his bicycle in the wrong lane, a claim could potentially be barred. However, we need to wait and see what the accident report reveals.
