An employee of the Union Pacific Railroad Co is seeking damages over $1 million under the Federal Employee Liability Act (FELA) after falling over a broken telephone wire on the ground causing injury.
According to the plaintiff, Phillip Roberts, the Union Pacific Railroad Co failed to provide him a safe work environment, as well as a reasonable pathway for him to work. The lawsuit also states that the Union Pacific Railroad Co failed to clear vegetation from the walkways, which is required by law.
Phillip Roberts told attorneys that the accident caused damage to his back and legs, and as a result Robert’s suffered from lost wages and continuing physiological discomfort. According to Robert’s the accident will continue to cause a loss of wages and depression, which is why Robert’s is taking the Union Pacific Railroad to court.
The Federal Employee Liability Act (FELA) was past in 1908 after an overwhelming number of deaths occurred throughout railroad workers. Under FELA, railroad workers have the ability to sue the railroad companies for losses they may suffer after a work related injury. Millions of dollars have been paid out under the FELA laws, allowing railroad workers to get back to their lives quicker and providing some compensation for the physical and physiological injuries they received.
Under FELA, Roberts may be able to receive damages for his pain and suffering as well as any wages lost during his time off of work. The trial begins mid August.
