The North Carolina Wrongful Death Lawyers’ Perspective
This is a very tragic reminder of how dangerous it is to walk alongside a highway. If your vehicle breaks down on the side of the road, the safest measure you can take is to stay in the vehicle. Getting out and lighting flares or putting up reflective triangles is a great safety measure to let passing vehicles know you are you there but you should quickly return to your vehicle. The safest thing you can do is to stay put until help arrives, but if circumstances force you to leave your vehicle there are few things to keep in mind. Walk against the flow of traffic so you can see approaching vehicles and be able to react if needed, stay as far away from the highway as you can, and if you have a flash light in your car carry it with you.
If you or a loved one has been injured or killed while walking along a highway you should contact a North Carolina (NC) personal injury/wrongful death lawyer that has an excellent knowledge of pedestrian laws. Pedestrians are protected by state law while crossing the street within a crosswalk but when a pedestrian is struck alongside a highway it can make for a much more difficult case. The sooner evidence can be gathered and the scene of the accident investigated the better the opportunity to build a potential claim. If it can be proven that the driver was negligent in anyway; meaning distracted or reckless driving this will grant the opportunity for punitive charges as well. A private consultation with a North Carolina (NC) wrongful death lawyer will allow for you to learn all your legal options.
