Driver Who Caused Fatal Accident in Durham Charged with Felony Death by Motor Vehicle

What Happened

The driver who apparently caused the accident that killed North Carolina (NC) comedian Brian E. Kiley, is now facing criminal charges including felony death by motor vehicle.

The victim, Mr. Kiley, was driving a Nissan Maxima on Interstate 40 East (I-40 East) in Durham, NC when he was hit from behind by a Honda Civic. Both cars overturned and Mr. Kiley was pronounced dead at the scene, according to The Tennessean.

The apparently at-fault driver was charged with driving while impaired by police.

Our firm reported on the this tragic accident when it initially occurred and it is not surprising, based on the facts available, that the driver of the Civic is now facing serious criminal charges.  Felony death by motor vehicle is a Class D felony. This means a Level 1 offender with no prior record can be sentenced to a minimum/maximum term of 80 months (nearly 7 years), according to Chetson.com.
