CPSC Files Complaint against Deadly Infant Seat Manufacturer

Comments (0)

What happened:

The U.S. Consumer Product Safety Commission (CPSC) has filed an administrative complaint against Baby Matters, LLC, of Berwyn, PA., the manufacturer of Nap Nanny® and Nap Nanny Chill™ infant recliners. In the complaint, the CPSC alleges that the Nap Nanny Generation One and Two, and Chill model infant recliners contain defects in the design, warnings and instructions, which pose a substantial risk of injury and death to infants. In a 3-0 vote, the commission approved the filing of the complaint, which seeks an order requiring that Baby Matters, LLC to notify the public of the defect and offer consumers a full refund.

The CPSC has received over 75 reports of injuries to infants caused by falling out of the chair. The Nap Nanny Generation Two is allegedly responsible for four infant deaths, the Nap Nanny Chill responsible for one.

Both the CPSC and the manufacturer issued a joint recall of the products in July 2010, announcing an $80 coupon to consumers to apply to the purchase of a newer model recliner. At the time of the voluntary recall, there had been a report of one infant death and 22 injuries – even though the infants were placed in the harness on the recliner. Over 50 more complaints were received, and four more infants’ deaths, despite the improved warnings and instructions provided by Baby Matters.

The North Carolina Injury Lawyer Perspective:

It is inconceivable that a company would allow 5 babies to die, with dozens and dozens and dozens of more being injured, and still keep their product on the market. We hope that the CPSC can publicize this dangerous product quickly so that no other parent has to suffer the tragedy of losing a child.
