Apex Gymnastics Settles Lawsuit from Chemical Explosion

Apex, N.C. — Apex Gymnastics has settled its lawsuit over a 2006 explosion and fire at a nearby hazardous materials processing site that forced the studio to close temporarily, according to a Thursday filing in federal court in Raleigh. Terms of the settlement weren't disclosed. The gymnastics studio opted out of a class-action settlement against Environmental Quality Industrial Services over the Oct. 5, 2006, chemical fire.

About 17,000 people were forced to evacuate their homes because Apex officials feared toxic chemicals were in the plume of smoke that spread over the town. Businesses near the EQ plant also had to shut down for several days.

Investigators determined that improperly stored canisters caused the rapid spread of the fire throughout the facility. EQ and two Alabama-based companies that sent the canisters to the plant agreed in 2009 to pay compensation to 1,678 residents and business owners. Each household in the settlement received up to $750, while each business received up to $2,200. EQ also agreed not to reopen the facility to settle a state fine over environmental violations.

Investigation Uncovers that Mall Food Court Trays as Dirty as Toilet Seats

A CBC investigation took samples from those plastic trays at mall food courts and the results are pretty disgusting. The CBC reporter took swaps from food trays from three different mall food courts, and then took a swab from a gas station toilet.

A microbiology professor at the University of British Columbia, Dr. Bob Hancock, did the test and says they saw as many bacteria on the food trays as they saw on the toilet. The mall food court trays had different types of bacteria, but they had some pathogens that can cause infection.

A high degree of care attaches to the company or person providing the food for sale and consumption. As in any case, it is important to save a receipt showing a purchase whether in a restaurant or a retail establishment and it is important to hold on to any available evidence that can confirm the personal injury caused by the food product. Companies that defend these cases are highly suspicious of these claims so it is important that witnesses and independent corroboration evidence be located as soon as possible.

Two Burned and Hospitalized at White Oak Nursing Home in Charlotte, North Carolina

Two nursing home residents have been burned and taken to the hospital from a skilled nursing center in southeast Charlotte, North Carolina (N.C.). The burn accident happened at White Oak Manor on Craig Avenue last Saturday night. The Charlotte Fire Department says they still are not sure how the people were burned, and the cause is under investigation.

White Oak Manor is a 180 bed skilled nursing center near Cotswold Mall. The facility also includes a separate independent living apartment community. Both individuals were taken to the hospital. One of the victims is said to have life-threatening injuries.

People are put into nursing homes when their family members can no longer take care of them. These are supposed to be safe havens for the residents, but there are many dangers that are a part of nursing home living.

    Understaffing

  1. The biggest problem nursing homes face is understaffing. There's a nursing shortage as well as a shortage of certified nursing assistants (CNAs) who handle the day-to-day physical care of each patient.
  2. Illnesses

  3. The biggest problem nursing home residents face is getting infections and colds on a consistent basis. Some residential areas need constant cleaning, and often there's not enough staff to get it done.
  4. Mentally Ill Residents

  5. Mentally ill patients are a major problem in nursing homes. Some patients suffer dementia or from Alzheimer's disease and can be dangerous to others.
  6. Predators

  7. Residents sometimes suffer physical or sexual abuse from other residents and staff. The screening processes for residents and staff aren't any more vigorous than they are in most jobs.
  8. Staying Alert

  9. It's important for family members or representatives of nursing home residents to look for signs of something wrong going on. If you can't get satisfaction from the nursing home, contact your state's Department of Health.

As with all serious injury cases, it is especially crucial to seek out professional legal advice in nursing home accident injury cases and we have the experienced injury attorneys to evaluate your claim. Our firm is ready to assist you  in reviewing your specific situation to see if your claim meets our criteria. In North Carolina, as well as every other state, there are laws on how long you have to file a suit also. Don't hesitate, call our toll free number and get confidential legal advice.
