500 People Killed Every Year in Preventable Rail Crossing Accidents

This number is far too high and the Federal Railroad Administration appears to be too focused on characterizing the victims of these accidents as "trespassers" as opposed to seriously addressing the problem. Wrong Way Driver Causes Deadly I-264 Car Crash Killing Two

Wrong-way driving on a busy road usually precipitates certain disaster to unsuspecting motorists. Recently, a wrong-way driver caused the death of two motorists on I-264 east as he drove his car up the wrong ramp and crashed into another vehicle killing himself and a Chesapeake, VA, resident.

Kannapolis, North Carolina Train Wreck Kills Two

Two men whose names were not released were killed when a train struck both of them Friday evening at the intersection of 18th Street and North Main Street in Kannapolis, NC.  Apparently, the other man was trying to pull the other out of the rail track when they were hit by the train.  An Amtrak spokeswoman said the train left Charlotte on its way to Raleigh with 100 passengers on board. Fortunately, none of the passengers were injured. The train continued onto Raleigh after a two hour delay.

According to investigators, the two men were walking home from work when the train struck them. Both of the men were working at the Kannapolis Britthaven Nursing Home.  The entire nursing staff as well as the residents was deeply saddened by the accident and told WBTV that facility counselling support will be available for the residents, staff and for the bereaved family.  Police investigation of the accident is still ongoing.

A graph of Railroad Accident Statistics by state presented by statemaster.com shows that Wyoming has the highest railroad accident statistics in 51 states, while North Carolina was number 26 in the rank.  However, in another accident statistics graph presented by the same website, it also shows that the fatality rate is high as well as the injury statistics.  Clearly, most of railroad accidents end up in serious injuries and fatalities.

Amtrak Train Strikes and Kills Cary Man

The police in Cary, North Carolina have reported that an Amtrak passenger train struck and killed a man along its railroad tracks near East Chatham and Trinity Roads early last Saturday morning. Evidently the Wake County man whom Cary police describe as in his late 30’s had died at the scene on the tracks.

According to Sergeant Gazaway, who had responded to the accident, Amtrak’s engineer saw the man walking along the rail tracks prior to striking the man. Cary police do not know exactly why the man was walking the tracks as of this hour. They speculate that he may have had a death wish.  The railroads always claim that it was suicide when anyone gets killed by them at a crossing or on its tracks.The Amtrak train was headed away from Raleigh towards the west at the time of the accident.

In many cases large railroad companies such as Amtrak attempt to keep their accidents and rates of death or injury to pedestrians or passengers of its rail cars away from public scrutiny. Were Railroad Workers In Danger of Asbestos-Related Mesothelioma Cancer?

When you hear about mesothelioma, the deadly cancer that is usually caused by asbestos exposure, you usually think about shipyard workers, miners, construction workers, and others who probably were often exposed to the toxic fiber. Yet many do not know that thousands of railroad workers have been exposed to asbestos and have an increased chance of developing asbestos-related cancer.

Both steam and diesel locomotives build between the 1940s and 1980s contained large amounts of asbestos, and many locomotive workers and conductors were unknowingly exposed to asbestos. Even many of the buildings and railroad terminals were filled with asbestos-containing building materials and asbestos-based insulation.

At this time, the use of asbestos has been banned in most Western countries. However, many were exposed to the dangerous material years ago and are still
at risk for developing mesothelioma. In other cases, asbestos may still lurk in older buildings and other environments.

Young Man Killed by Freight Train Haunted by Railroad Accidents

Sean LePage was killed by a freight train. He was just 23 years old and had his whole life ahead of him.

 Sean was apparently sitting on the train tracks by himself at around 1:30 am when the freight train sped by and took his life. The tracks were owned by Pan Am Railways and the train was owned by CSX.

It's unclear why Sean was at the tracks at that hour of the morning, but one thing is for certain: Sean was haunted by railroad accidents.

Six years ago, a close friend of Sean's named Cory Styrczula was killed by a freight train. In 2007, another close friend of Sean's was also killed by a freight train.

It is clear pedestrians use the tracks regularly to walk to and from locations in town since the tracks were close to neighborhoods and the Bradford commuter station.

The trauma and pain of losing two friends in such tragic accidents stayed with Sean for many years and is an example of the unintended consequences associated with railroad accidents - they don't just affectthe person involved in the accidents, but friends and family as well.

As an injury lawyer whose represented people seriously hurt in train accidents, I understand the emotional trauma that is carried by the people closest to the injured victim.

11 People Killed in Caltrain Railroad Accidents

Caltrain, injury lawyer, railroad, accident, accidents, rail, trainSo far, 11 people have been killed in railroad accidents involving Caltrain, according to the Contra Costa Times.  This is an alarming number considering these deaths have all occurred after May and we still have a number of months left in the year.

Most recently, a man driving a 1998 Honda Civic was struck by a Caltrain after his vehicle broke down on some rail tracks and died instantly.

The high number of fatalities puts a dubious spotlight on the fact that Caltrain designated September "Railroad Safety Awareness Month," according to RT&S.

Other railroad companies have been involved in far fewer fatal railroad accidents, so clearly Caltrain needs to take heed of their safety awareness month and thoroughly examine their safety procedures. 11 deaths in five months is far too high in the opinion of this injury lawyer.

Keyser, West Virginia (WV) Man Killed When Train Hits His Stuck Scooter

According to The Associated Press, 67-year-old Floyd Kenneth Wilt was killed when his scooter was struck by a freight train.  The accident happened on September 8, 2009.  Wilt’s scooter was stuck between the rails and the asphalt.  The engineer tried to stop when he saw Wilt stuck on the tracks but was unable to halt the train.  Crossing gates were down at the time of the crash, but police do not know how long Wilt had been stuck on the rails.

24-Year-Old Man Killed by Amtrak Train

train, accident, Amtrak, accidents, injury lawyerA young man was killed by an Amtrak train in Clark County, Washington (WA). He was just 24 years old. It's the ninth death from a train accident in that area. Unfortunately, these types of train accidents occur in many areas, including Carolina.

My deepest condolences go out to the young man's friends and family.

I believe these types of tragic incidences can be prevented and are far too common. Amtrak had 171 train accidents in 2006. That's relatively low considering one of their competitors, Union Pacific Railroad, had 1094 accidents in 2006. In either case, the number needs to go down.

Young Boy Killed in Train Accident

train, accident, injury lawyer, train accident lawyerA father and his 3-year-old son were enjoying the day walking near some train tracks. In an instant, everything changed. The young boy was hit by a freight train and killed, according to the Missoulian.

This situation is similar to an accident in Westmoreland County, Pittsburgh which involved a 15-year-old boy who was riding his bike along some train tracks and was hit by a train and died, according to kdka.com.

As a father with young children, these types of train accidents are so sad to hear. I've represented people seriously injured in train accidents so I understand the type of devastation they can inflict in an accident.

Any parent who loses a child feels a pain that's virtually indescribable.

Two Boys Seriously Burned in Accident Involving Amtrak and Norfolk Southern

railroad accident, rail injury, injury lawyer, railroad accident lawyerJeffrey Klein and Brett Birdwell, two young boys, had their lives forever changed by the negligent actions of Amtrak and Norfolk Southern. The boys were out one day and decided to venture onto rail property owned by Amtrak and Norfolk Southern. Neither was prepared for the lethal shock that was inflicted by catenary lines (overhead lines that transmit electricity to trains on a rail system) and caused both to be severely burned.

Over 75 percent of Jeffrey's body was burned while Brett has 18 percent of his body burned. Both had to go through extensive rehabilitation and their lives may never be the same, according to law.com.

Fortunately, a jury awarded Jeffrey and Brett $24 million in punitive and compensatory damages. It was determined Amtrak and Norfolk Southern were negligent and should have taken the necessary safety precautions in connection to their railways and catenary lines.

The boxcars in which Jeffrey and Brett were on did not have any explicit warnings indicating the dangerous levels of electric current that led to their injuries.

"Amtrak had every reason to know trespassers were regularly on its tracks and that teenage boys were inclined to climb to the top of parked boxcars," said U.S. District Judge Lawrence F. Stengel, who presided over the case at trial.

No amount of money will ever be able to give Jeffrey and Brett their former lives back, but they should be able to get quality treatment and, hopefully, prosper in the future. I have children and represented people seriously hurt in rail accidents, so these types of verdicts give me hope that justice can be obtained in a situation where negligence was determined in a court of law.

Employee of the Union Pacific Railroad Co Injury Case Starts August 17

An employee of the Union Pacific Railroad Co is seeking damages over $1 million under the Federal Employee Liability Act (FELA) after falling over a broken telephone wire on the ground causing injury.

According to the plaintiff, Phillip Roberts, the Union Pacific Railroad Co failed to provide him a safe work environment, as well as a reasonable pathway for him to work. The lawsuit also states that the Union Pacific Railroad Co failed to clear vegetation from the walkways, which is required by law.

Phillip Roberts told attorneys that the accident caused damage to his back and legs, and as a result Robert’s suffered from lost wages and continuing physiological discomfort. According to Robert’s the accident will continue to cause a loss of wages and depression, which is why Robert’s is taking the Union Pacific Railroad to court.

The Federal Employee Liability Act (FELA) was past in 1908 after an overwhelming number of deaths occurred throughout railroad workers. Under FELA, railroad workers have the ability to sue the railroad companies for losses they may suffer after a work related injury. Millions of dollars have been paid out under the FELA laws, allowing railroad workers to get back to their lives quicker and providing some compensation for the physical and physiological injuries they received.

Under FELA, Roberts may be able to receive damages for his pain and suffering as well as any wages lost during his time off of work. The trial begins mid August.

Car-Train Collision Kills High Point, NC, Man

A High Point, North Carolina, man has died as the result of a train-car collision according to the Greensboro News & Record. The accident took place around 3:40 in the morning on Wednesday, June 10.

High Point Police reported that the man, Danneil Davis, backed his vehicle onto the tracks that evening, which was then struck by an oncoming westbound train. The impact of the train-car crash caused the car to slide into a nearby pedestrian, 21-year-old Kevin Boyd.

Boyd was rushed by emergency workers to
Wake Forest University Baptist Hospital, where he died from his critical injuries. Davis has been charged with driving with a revoked license, an inspection violation, obstructing the movement of a train and a safe movement violation.

High Point authorities report that no one else in the car or train, including the driver, Davis, were injured in the accident.

NC Girl Killed In Train Accident In Kinston

A train accident in Jones County still leave unanswered questions according to DigTriad.com. A 13-year-old girl from Kinston, North Carolina, was hit and killed by an oncoming train after falling asleep on the tracks.

Damaris Guzman allegedly ran away from home with her cousin on Wednesday night, became tired, and fell asleep on the railroad tracks. The conductor of the train never saw the bodies in the tracks and did not break or stop - their bodies were found an hour after the accident. Guzman was killed by the train accident, though her cousin survived with
serious injuries.

Ditrict Attorney Dewey Hudson said that the fatal train accident was still under investigation, as it is not known why the children would not have woken up when the train was approaching - or why they would have fallen asleep on the tracks to begin with.

Seneca, SC, Man Struck And Killed In Passenger Train Accident

Oconee County Coroner Karl Addis reported on Friday that 49-year-old Marshall Edwin Brady Jr. of Anderson, South Carolina, was struck and killed by an Amtrak passenger train. The fatal train accident took place on Thursday night at 10:30 p.m. in downtown Seneca, South Carolina. Addis said that the man suffered multiple serious injuries.

The train's conductor reported seeing something on the tracks, but that he didn't have time to fully brake and stop the train. He stopped the train and found the body near the tracks, dressed in dark clothing.

Police do not know why the man was trespassing on the train tracks. Brady was released from
Oconee County Jail earlier that day. He was in jail on trespassing charges and had been incarcerated since March 25.

The northbound train was traveling from New Orleans to New York. The
train accident is still under investigation.
